When the arrest warrant was issued by an Essex County judge last week, Brescia was charged with first-degree aggravated sexual assault and second-degree sexual assault. Additional charges could be added as authorities continue to investigate the case.
What to do if your attorney is suspended
If your attorney is suspended from the practice of law, it is important to take some time to understand what this means for you and your case. Here are seven things you should do if your attorney is suspended
1) Make sure that all attorneys on your team can step in for the suspended attorney;
2) Keep yourself informed about how long the suspension will last;
3) Make sure that you can continue with your legal matters without an interruption or delay;
4) Consider filing a motion to change venue because lawyers from a different jurisdiction may not be able to represent you;
5) Work closely with all of your attorneys so they know exactly what's going on in your case;
6) Be mindful that there may be some details that need adjusting in light of any changes made by the suspension order (such as contact information); and
7) Understand that suspending an attorney does not necessarily mean their license has been revoked.
How I started practicing law
I started practicing law in 2001, after I was admitted to the bar. I worked for a small firm for a few years, before going out on my own. I handled mostly criminal defense cases, and did some civil work as well. In 2006,
I was suspended from practicing law for two years, after I was convicted of a felony. After my suspension ended, I started my own firm again. And now, I'm back to doing what I love - helping people who need it the most.
Listening to the devil in my head
I know I should have listened to my gut. I never should have taken that case. It was a mistake, and now I'm paying for it. I'm suspended from practicing law for six months. My name is Ken Dawson. I used to be an attorney until I got in trouble with the bar association because of one too many DUIs after a night out drinking with friends.
The good news is that at least I'm still alive and still get to do what's most important in life: spend time with my family, drink some beers on occasion, eat some barbecue every now and then, listen to music at home or on the beach...I could go on but you get the idea. And maybe someday soon the law will let me back in so we'll see what happens then!
Failing to provide zealous representation
An attorney who is accused of failing to provide zealous representation can be subject to sanctions, including suspension from practice. The decision to suspend an attorney is usually made by a court or disciplinary board.
When an attorney is suspended, they are no longer able to represent clients in court or give legal advice. If you have been accused of failing to provide zealous representation, you should contact an experienced attorney right away.
Realizing I needed help
I realized I needed help when I was first starting out as an attorney. I had no idea how to run a law firm, and I didn't want to make any mistakes that could jeopardize my career. Thankfully, I found a great mentor who taught me everything I needed to know about running a successful law firm.
However, there was one problem: my mentor was suspended from practicing law. Fortunately, they were able to teach me the ins and outs of the profession before being removed from the rolls of attorneys.
Now, they're able to spend more time with their family while still teaching me what they know through email correspondence. And thanks to their guidance and wisdom, I've been able to start my own successful law firm!
Starting down the road to recovery
It can be difficult to know where to start when you've been dealt a setback, but it's important to remember that you're not alone. Here are a few steps you can take to start down the road to recovery - If substance abuse is a problem, get professional help right away to avoid making things worse.
- Seek out support systems that allow you to talk openly without judgement; this may include Alcoholics Anonymous or Narcotics Anonymous meetings as well as talking with family members or friends.
- Find other ways of coping with stress such as volunteering, exercising, reading a book, playing music, cooking dinner together with someone else – anything that has meaning for you and brings joy into your life.
A call for vigilance among lawyers
The legal profession is one of the most important in our society. It is a pillar of democracy and the rule of law. That's why it is so disturbing when an attorney is suspended from practice.
This call for vigilance among lawyers is not about one bad apple. It's about the need for all of us to be on the lookout for signs that something may be amiss.
